Email regarding W-8BENA

I really don’t wish to give out any personal information for any crypto project, except exchanges. The sign up page only asked an email, didn’t even check if it’s working or not. Im not an US person, I did not received any email yet, but if i do, i think i will just shut down my nodes.

It is of course your prerogative to leave if the terms do not suit your circumstances.
We would be sorry to see you go.

I must reiterate for everyone the importance of providing accurate and truthful information in the forms if you are required to be submitting them.

Storj is not a “crypto project”. It’s a distributed storage project. It happens to pay in crypto tokens. But this is irrelevant.

If they were paying in euros or usd you would still needed to provide that information just the same.

This fanatic and obnoxious overprotectiveness of PII is getting out of hand.

Storj as a business needs to report taxes, just like anyone else. They need to have proof of what they pay and to whom. Hence, the need to know their vendors. In this case — you.

Go try to sell services to any legit company as a vendor anonymously. Let’s see how far you go.

True.

Go try to sell services to any legit company as a vendor anonymously.

I think a legit company would require me to register first, and would not let me sell goods without knowing my name and country / address.
It wouldn’t be unexpected to send proof of the stuff they already asked if needed.
But storj just letting vendors sign up with just an email address, letting them sell for a long time, and ask a bunch of unexpected stuff later.
Also, it fees weird while “From Storj’s perspective we aren’t sending you money. We are sending you an item. The token.”.

No. My suggestion you are referring to was to Storj to seek advice from business and tax consultants if there are legal options without these forms and bureaucracy.
Basically my idea was if Storj would create a non-US subsidiary and use this for everything SNO related including payments, then eventually SNOs would not have to fill out US forms. Because then STORJ USA would only pay STORJ XYZ for providing the SNO services and STORJ XYZ would pay the single SNOs.
That’s the general idea. But I am not a international tax lawyer or business consultant, so I can only suggest to seek professional advice if such legal ways exist.

Additionally a non-US subsidiary if it is created in the EU for example could attract customers outside from the US especially as the GDPR options to store data only on EU-nodes has received better visibility recently on the website: Compliance.

I think this subsidiary will be accounted as US-based anyway. But also the country where it would be opened will do the same but in their favor… So it could be twice as more bureaucracy and taxes, especially if there is no agreement on double taxing for that country…
Doesn’t look so simply. However, it’s my opinion and I’m not a lawyer or a tax adviser anyway.

Thus my suggestion to discuss this with professionals who know international tax and company laws to get expert opinion if such ways exist and what countries would be favorable for such a construction to have least additional bureaucracy and taxes.

As stated in the instructions for the form W-8BEN:

Expiration of Form W-8BEN.

Generally, a Form W-8BEN will remain in effect for purposes of establishing foreign status for a period starting on the date the form is signed and ending on the last day of the third succeeding calendar year, unless a change in circumstances makes any information on the form incorrect. For example, a Form W-8BEN signed on September 30, 2015, remains valid through December 31, 2018.

However, under certain conditions a Form W-8BEN will remain in effect indefinitely until a change of circumstances occurs. To determine the period of validity for Form W-8BEN for purposes of chapter 4, see Regulations section 1.1471-3(c)(6)(ii). To determine the period of validity for Form W-8BEN for purposes of chapter 3, see Regulations section 1.1441-1(e)(4)(ii).

Change in circumstances.

If a change in circumstances makes any information on the Form W-8BEN you have submitted incorrect, you must notify the withholding agent, payer, or FFI with which you hold an account within 30 days of the change in circumstances and you must file a new Form W-8BEN or other appropriate form.

If you use Form W-8BEN to certify that you are a foreign person, a change of address to an address in the United States is a change in circumstances. Generally, a change of address within the same foreign country or to another foreign country is not a change in circumstances. However, if you use Form W-8BEN to claim treaty benefits, a move to the United States or outside the country where you have been claiming treaty benefits is a change in circumstances. In that case, you must notify the withholding agent, payer, or FFI within 30 days of the move.

If you become a U.S. citizen or resident alien after you submit Form W-8BEN, you are no longer subject to the 30% withholding rate under section 1441 or the withholding tax on a foreign partner’s share of effectively connected income under section 1446. To the extent you have an account with an FFI, your account may be subject to reporting by the FFI under chapter 4. You must notify the withholding agent, payer, or FFI within 30 days of becoming a U.S. citizen or resident alien. You may be required to provide a Form W-9. For more information, see Form W-9 and its instructions.

You guys should put an announcement section in the node dashboard. Many SNOs use a secondary email in config file. I just read the email by now. Is it too late to submit the form?

  1. It is not too late to submit the form
  2. The purpose of providing an email address in your node configuration is so that you can receive important communications from Storj, so it is recommended you use an email address you frequently monitor for this purpose.

  1. Okay I’ll do that.
  2. I got spam with node online/offline messages that’s why I changed to a secondary email address.

If you decide not to submit anything as you want to no one to know you participate in storj , is the 30% deducted after the $600 ? - or then on an entire amount?

Hi @ItsHass ,
I’ve forwarded our question internally.
Storj is closed today for Martin Luther King Jr. Day so we will probably have your answer Tuesday at the earliest.

Edit: @ItsHass , Support guided me to this article that should hopefully answer your questions in detail.
